attorney to liquidate for your Orator the whole business relative to said partnership transactions with the heirs of Andrew Greer at the same time that the said Nathaniel was making settlement for himself, which power or a copy, your Orator has ready to produce to your Honor when necessary. Your Orator further states that in the month of October, of the same year, he did proceed to West Tennessee and procured a deed of conveyance from the heirs of Andrew Greer, deceased, for one thousand and seventy acres of said tract of land for two thousand and one hundred and forty acres originally entered on Certificate exhibit "D", and to which you Orator has also ready to produce to your Honor at such time as may be required. Your Orator expressly charges that at the time he gave to said Nathaniel Taylor the power of attorney before name, that it was not in pursuance to any sale of the interest made to the said Taylor, which your Orator had in said tract of land, nor was any consideration paid by said Taylor to your Orator then or at any other time for the same.
Your Orator states further that the heirs of Greer, for the trouble and expense consequent upon perfecting said Certificate into a Grant, charged the said Taylor and your Orator the one-fourth part of said tract of land, which would amount to five hundred and thirty-five acres, added to that one-third interest which the said Andrew Greer held in the same by reason of the Original Agreement, would leave the quantity of one-thousand and seventy acres to said Taylor and your Orator, which quantity is contained in the deed made by the said heir to the said Taylor.
Your Orator further states that after deducting the fifteen hundred acres certificate, which he received from the five thousand and ninety acres contained in the three exhibits "C", "D", & "E", there would be still due and coming to your Orator one hundred and ninety six and two-thirds of acres out of the aforesaid Grant of two thousand one hundred and forty acres, and after deducting there from one fourth the charge made by Greer's heirs for locating and entering said land, your Orator would be entitled to one hundred and forty seven acres of said tract which was conveyed by the heirs of Andrew Greer to said Nathaniel Taylor.
Your Orator further states that said tract of land is exceedingly valuable, and surpassed by little land for fertility, the title to which, although, your Orator's equitable interest still remains in the heirs of Nathaniel Taylor by reason of the before named conveyance. Your Orator states further that some time about 1816, the said Nathaniel departed this life, leaving the following named heirs and representatives, towit: James P. Taylor, Alfred W. Taylor, Ann, who inter-married with Thomas D. Love, Elizabeth, who intermarried with Thomas Taylor, Lorina, who inter-married with Jacob Tipton, and Mary Taylor, Saraphina Taylor and Nathaniel Taylor, infants and minors, all of whom your Orator prays be made defendants to this Bill; as also the heirs of said Andrew Greer, deceased, as before named, and that a guardian be appointed for said minors to defend this suit.
Your Orator further states that since the death of said Nathaniel, Mary Taylor, widow, and James P. Taylor took upon themselves the execution of the last Will of said Nathaniel Taylor, as executor and executrix, and your Orator has repeatedly pressed said executor, James P., to liquidate said matter either by making a conveyance of the aforesaid one hundred and forty seven acres of land, so conveyed to his testator by the heirs of Andrew Greer, deceased, under the power of attorney of your Orator, or give to your Orator an equivalent therefore in money, which the said James P., has frequently
